TERMS OF SERVICE

these terms govern your use of deadskinclub.com and any purchase you 
make through it. by using the site or placing an order, you agree to 
these terms. if you don't agree, don't use the site.

we keep this short. it still has to do the legal work.

1. WHO WE ARE

dead skin club is operated by jeffrey mendoza, a sole proprietorship 
based in pasadena, california. when these terms say "we," "us," or 
"dsc," that's who we mean. "you" means the person using the site or 
placing an order.

2. WHO CAN USE THIS SITE

you must be at least 18 years old, or the age of legal majority in your 
jurisdiction, to make a purchase. by placing an order you confirm you 
meet that requirement.

we reserve the right to refuse service to anyone, cancel any order, 
or limit quantities — for any reason or no reason — at our discretion.

3. PRODUCTS, DROPS, AND THE VAULT

dead skin club operates on a drop economy. each volume is released for 
a limited window. when a volume closes, every sku from that drop moves 
to the vault — permanently. vault items are never restocked, never 
reproduced, and never available for purchase again. this is a feature 
of the brand, not an oversight.

product images are representative. minor variations in print placement, 
fabric weight, color, and finish are normal and not grounds for a 
refund. we make every effort to display colors accurately, but your 
screen may render them slightly differently than the physical garment.

we reserve the right to correct typos, pricing errors, and inventory 
listings on the site without notice. if an order is affected by a 
pricing error, we'll contact you before charging or shipping.

4. ORDERS AND PAYMENT

placing an order is an offer to purchase. we accept your offer when 
we send order confirmation. until then, we may cancel any order at our 
discretion, including for suspected fraud, payment issues, stock 
availability, or violation of these terms.

prices are in us dollars. you're responsible for any applicable sales 
tax, which is calculated at checkout based on your shipping address.

payment is processed by shopify payments and other authorized 
processors. we don't store full credit card details on our servers.

5. SHIPPING

shipping policies are detailed on our shipping page and incorporated 
into these terms. domestic orders ship within 5–7 business days. 
international orders ship within 7 days and may incur import duties 
that are your responsibility.

risk of loss transfers to you when the carrier accepts the package. 
once tracking shows delivered, the order is considered fulfilled.

6. RETURNS AND REFUNDS

returns and refunds are governed by our refund policy, which is part 
of these terms. summary: all sales final. sizing exchanges available 
within 14 days for unworn, unwashed items in current inventory. 
defective or wrong items are replaced at no charge.

7. INTELLECTUAL PROPERTY

everything on this site — the skull mark, the dead skin club name, 
all designs, photography, copy, and graphic assets — is owned by us 
or used with permission. you may not copy, reproduce, modify, 
distribute, or use any of it for any commercial purpose without 
written permission.

you may share product photos and lifestyle content on your own social 
media, with attribution. reposting our content to your business 
account, listing our products for resale on any platform, or producing 
derivative merchandise is not permitted.

if you tag us on social media or send us photos wearing our product, 
you grant us a non-exclusive, royalty-free license to repost, share, 
and use that content for marketing purposes, with credit to your 
handle.

8. USER CONDUCT

don't use this site to:

— buy product with the intent to resell on secondary marketplaces.
— place fraudulent orders.
— attempt to access non-public areas of the site.
— probe, scan, or test the vulnerability of our systems.
— scrape, harvest, or extract data from the site.
— misuse our customer service channels.
— harass, threaten, or abuse our staff.

we reserve the right to ban any customer, refund and cancel their 
orders, and block them from future purchases for violating this 
section.

9. RESALE AND BOTTING

dead skin club is a direct-to-member brand. we do not authorize any 
third-party resellers. orders that appear to be placed by bots, 
resellers, or for the purpose of secondary-market resale will be 
cancelled at our discretion. we may limit one order per household 
on high-demand drops.

10. ACCOUNTS

if you create a customer account, you're responsible for keeping your 
login credentials secure and for any activity that happens under your 
account. notify us immediately if you suspect unauthorized access.

we may suspend or close accounts for violation of these terms.

11. DISCLAIMERS

the site and our products are provided "as is." while we stand behind 
the quality of our garments, we make no warranties beyond what's 
required by law. we don't guarantee uninterrupted access to the site, 
error-free operation, or that any defects will be corrected.

we are not liable for any allergic reaction, skin irritation, or 
sensitivity caused by our garments. if you have known fabric or dye 
sensitivities, contact us before ordering.

12. LIMITATION OF LIABILITY

to the maximum extent permitted by law, dead skin club, its founders, 
employees, and contractors are not liable for any indirect, incidental, 
special, consequential, or punitive damages arising from your use of 
the site or our products. our total liability for any claim is capped 
at the amount you paid for the product giving rise to the claim.

some jurisdictions don't allow these limitations. in those cases, the 
limitations apply to the maximum extent permitted by local law.

13. INDEMNIFICATION

you agree to defend, indemnify, and hold dead skin club harmless from 
any claim, loss, or expense (including reasonable attorney fees) 
arising from your violation of these terms or your misuse of the site 
or our products.

14. GOVERNING LAW AND DISPUTES

these terms are governed by the laws of the state of california, 
without regard to conflict-of-law principles. any dispute arising 
from these terms or your use of the site will be resolved in the 
state or federal courts located in los angeles county, california.

before filing any formal claim, you agree to contact us first at 
hello@deadskinclub.com and give us 30 days to attempt resolution in 
good faith.

15. CHANGES TO THESE TERMS

we may update these terms periodically. material changes will be 
posted on this page with an updated "last updated" date. continued 
use of the site after changes constitutes acceptance of the new terms.

16. SEVERABILITY

if any provision of these terms is found invalid or unenforceable, 
the rest remains in full effect.

17. ENTIRE AGREEMENT

these terms, along with our refund policy, shipping policy, and 
privacy policy, constitute the entire agreement between you and dead 
skin club regarding the site and your purchases.
